User Agreement (Offer)

Self-employed Olga Yurievna Kotlyarova, TIN (Taxpayer Identification Number) 772784506805, hereinafter referred to as "Contractor", address: 108811, Russia, Moscow, Shakespeare St., house 28, building 5 (84.6), offers this Agreement to any natural person who has reached the age of majority and has full legal capacity and capability, to any legal entity, and to any sole proprietor willing to enter into the Contract for the provision of information services (hereinafter referred to as the "Contract") under the terms set forth below.

This Offer constitutes a public offer in accordance with paragraph 2, Article 437 of the Civil Code of the Russian Federation. Acceptance of the terms (acceptance) of the Offer is the complete payment by the Customer of the selected Service of the Contractor, or the making of the first payment for the Service if installment payments are provided, or payment for the cost of the Services through a banking or credit organization. By accepting the Offer, you (the Customer) confirm that you have fully read and agree to all the terms specified in the offer, and that you have received from the Contractor the necessary information about the procedure, terms, and other conditions of providing Services under the Contract. If you do not agree with the terms of the Offer, you are obliged to refrain from purchasing the Services and to cease using the Site.

TERMS AND DEFINITIONS:

Acceptance – full and unconditional acceptance of the Offer terms by the Customer.
Customer — any natural person who has reached the age of majority, possesses full legal capacity and capability, a sole proprietor, or a legal entity that has entered into a Contract with the Contractor under the terms of the Offer.
Offer – the current public proposal of the Contractor, addressed to any natural person who has reached the age of majority, possesses full legal capacity and capability, a sole proprietor, or a legal entity to enter into a Contract with him/her under the terms set out in the Offer.
Information Materials – author's video recordings, training lectures, and webinars, textual, graphical, and other materials owned by the Contractor (or third parties) and used by him/her to provide Services under the Contract.
Platform – the platform used by the Contractor to provide Services under the Contract, where the Information Materials are located.
Access – the right of the Customer under the Contract to view, familiarize with, and otherwise use the Information Materials on the Platform.

1. SUBJECT OF THE CONTRACT

1.1. The subject of the Contract is the provision of paid information and consulting services by the Contractor to the Customer by providing Access to Information Materials under the terms specified in the Contract. The Customer pays for the Services of the Contractor in accordance with the tariff selected, posted on the Site.

2. RIGHTS AND OBLIGATIONS OF THE PARTIES

2.1. The Contractor undertakes:
2.1.1. To provide the Customer with services in accordance with the terms of the Contract.
2.1.2. To use only the Information Materials for providing Services to which he/she has the appropriate rights.
2.2. The Customer undertakes:
2.2.1. To pay for the Services of the Contractor in the order, timing, and terms of the Contract.
2.2.2. Not to distribute the Information Materials obtained in the course of the Services.

3. PROCEDURE FOR PROVIDING AND PAYING FOR SERVICES

3.1. The order for Services is made by the Customer on the Site, and the Services are considered paid from the moment the funds are credited to the Contractor's bank account.
3.2. Payment for Services is made through the payment service indicated on the Site.

4. REFUND OF FUNDS

4.1. Refunds are made in the event of improper provision of Services. The Customer may send a refund request to the Contractor's email: info@polyana.agency.

5. LIABILITY OF THE PARTIES

5.1. The Contractor is not responsible for the Services not meeting the Customer's subjective expectations and for technical interruptions not dependent on his/her will.

6. DISPUTE RESOLUTION

6.1. Disputes and disagreements are resolved through negotiations, and only if the issue is unresolved — through legal proceedings.
